Agreement:
Under this Agreement, Brookside Economic Comment LLC ( Brookside Economic Comment , we, or us ) furnishes on-line economic and financial information, opinions, and services to visitors and subscribers. By visiting this website or by communicating with any owner, employee, or agent of Brookside Economic Comment LLC through any electronic means (including, but not limited to e-mail), phone or any other means of direct contact, you agree to be bound by this Agreement.

By continuing to use the Service, you agree to be bound by the changes in the new version of the Agreement.

User Conduct:
Memberships are provided on an individual basis. No password sharing is allowed, unless permission is granted in writing by Brookside Economic Comment LLC. Activity at the subscription portion of the website is monitored closely for any unauthorized use. At anytime, Brookside Economic Comment LLC may cancel the membership, with or without cause or notification, if a violation of this agreement is suspected and no refund will be given for any subscription previously received by Brookside Economic Comment LLC.
Registration for the Service
In order to access the Service, you must become a member of BrooksideLetter.com, which is the website and primary means of communication with the customers of The Brookside Letter, a publication of Brookside Economic Comment LLC. You must choose a unique (and inoffensive) username and password, and supply Brookside Economic Comment LLC with true, accurate, current, and complete information about yourself, as required on the Registration page. If the information you provide is untrue, outdated, incomplete, or inaccurate, or Brookside Economic Comment LLC has reason to believe it is, Brookside Economic Comment LLC reserves the right to terminate your membership, and further prohibit future use of the Service.
Termination of the Service:
You agree that you will be held responsible for any and all statements made and acts or omissions that occur through the use of your membership and password. You agree that Brookside Economic Comment LLC may at any time, and at its sole discretion, terminate your membership without prior notice to you for violating the TOU and in such an event you will not be entitled to receive a refund for any unused portion of your subscription.
Subscription Renewal:
Subscriptions will run for to the date shown at the time of subscription. Users will be offered an opportunity for 1 month ("the renewal period") to renew for the next term at the expiration of their current term at the new price. Failure to renew within the renewal period will make the subscriber ineligle for renewal pricing, and will require a new subscription to be initiate at the then current price for new subscribers.
All charges made for initial and following subscriptions are
final. All payments are nonrefundable.
Subscription Cancellation:
You may cancel at any time. This can be done through PayPal Subscriptions, or your Login Billing Preferences. After cancellation, please send a follow-up email, which will ensure that you are cancelled.
Brookside Economic Comment’s Proprietary Rights
The Service is the property of Brookside Economic Comment LLC and may only be displayed, formatted and printed for your personal, non-commercial use. You acknowledge that you do not acquire any ownership rights as a result of using the Service.
You agree to not reproduce, distribute, sell, publish, broadcast, or circulate any information, research, charts, website pages or drawings received through us to anyone without prior written consent. You may not post any content from this website to news groups, mail lists or electronic bulletin boards, or to other individuals or parties without prior written consent.
Copying and/or electronic transmission of any content of the Service is a violation of copyright law.
All information sent to The Brookside Letter or Brookside Economic Comment LLC becomes the property of Brookside Economic Comment LLC. All information may be used at Brookside Economic Comment LLC’s sole discretion.

Indemnification, Governing Law, and Jurisdiction: You agree to defend, indemnify, and hold us, our employees, and other representatives harmless from and against all liabilities, damages, claims, actions, costs, expenses (including reasonable attorneys fees), in connection with or arising from your violation of the TOU; your use of the Service; or your violation of the rights of any third party.
This Agreement is personal to you, and you may not assign your rights or obligations to anyone.
If any provision of this Agreement is invalid or unenforceable under applicable law, the remaining provisions will continue in full force and effect.
This Agreement shall be deemed to have been made in the State of New York, and shall be governed by the laws of the State of New York, exclusive of its rules governing choice of law and conflict of laws. The parties expressly stipulate to jurisdiction in Monroe County, New York. As an implied condition of use of the services provided, Brookside Economic Comment LLC has the sole right to choose the proper forum and/or jurisdiction for any proceeding and may, at its own option, require each party to submit to alternative forms of dispute resolution such as determined necessary and/or desirable by Brookside Economic Comment LLC.
YOU AGREE THAT IF ANY APPLICABLE AUTHORITY HOLDS ANY PORTION OF THIS LEGAL AGREEMENT, THE SOLE AND EXCLUSIVE MAXIMUM LIABILITY TO BROOKSIDE ECONOMIC COMMENT LLC FOR ALL DAMAGES, LOSSES, AND CAUSES OF ACTION SHALL BE THE TOTAL AMOUNT PAID BY YOU, IF ANY, FOR ACCESS TO THE BROOKSIDE LETTER WEBSITE OR ANY OTHER SERVICE OFFERED BY BROOKSIDE ECONOMIC COMMENT LLC.
